AAIPA Website Terms of Use

1. Acceptance and scope

By accessing or using AAIPA's public website, a user agrees to comply with these Terms to the extent permitted by applicable law. Registered portals, membership, client engagement, Execution Partner status and specific projects are governed by additional terms. If a specific signed agreement conflicts with these Terms, the specific agreement controls for that subject.

2. Website operator

The website is operated by the African Asset Integrity Professionals Alliance (AAIPA). Website enquiries: support@aaipaafrica.com. Postal address: IF 53 BlayEsthers' Place, Padmore Street, Community One, Tema, Ghana.

3. Information, not professional advice

Public website material is general information about AAIPA, its network and services. It is not an inspection report, engineering opinion, fitness-for-service determination, certification, legal advice, procurement commitment or guarantee of a particular professional's suitability. Decisions affecting asset integrity, lifting safety, shutdowns, operations or regulatory compliance will rely on a properly scoped engagement and authorised competent persons.

4. Professional registry status

A directory listing indicates only the status and attributes AAIPA has chosen to display as of the stated date. It does not guarantee continuing licence validity, availability, competence for every assignment, employment, insurance, project award or client acceptance. Users will complete project-specific verification and contracting.

5. Permitted use

• View public information for legitimate personal, professional or organisational purposes.
• Submit genuine membership, client, partner, training or contact requests through designated forms.
• Download material expressly offered for download, subject to any stated restrictions.
• Link to public AAIPA pages in a fair manner that does not imply endorsement.

6. Prohibited use

• Scrape, crawl, harvest, copy or compile the professional directory, contact details, profiles, credential labels, client information or other website data.
• Use AAIPA information for unsolicited bulk marketing, recruitment, profiling, resale, lead generation or creation of a competing directory.
• Attempt to bypass portal permissions, authentication, rate limits, download controls, project rooms or other security measures.
• Introduce malware, probe vulnerabilities, overload the service or interfere with another user.
• Create a false identity, impersonate a client/professional/company or submit forged, misleading or unauthorised information.
• Copy, republish, modify or commercially exploit AAIPA content, branding, forms or portal structure without written permission.
• Use an AAIPA-facilitated connection to circumvent AAIPA or another protected party; separate agreements may impose additional obligations.
• Upload personal, confidential, classified, export-controlled, critical-infrastructure or third-party material without authority and an appropriate secure channel.
• Enter confidential AAIPA, client or project content into public AI systems, automated extraction services or third-party tools without written authorisation.

7. User submissions

A person submitting information represents that it is accurate to the best of their knowledge, that they are authorised to submit it, and that its submission does not unlawfully infringe confidentiality, privacy, intellectual-property or other rights. AAIPA may reject, quarantine, remove or preserve submissions where reasonably necessary for security, compliance or dispute purposes.

8. Intellectual property

AAIPA's name, logo, website design, text, graphics, taxonomies, forms, training content and publications are owned by or licensed to AAIPA. No licence is granted except the limited right to use the public website as these Terms allow. A user retains rights in their own submissions but grants AAIPA the limited rights necessary to receive, store, review and use them for the requested and disclosed purpose.

9. Directory and third-party information

Some information originates from members, clients, Execution Partners, credential issuers or public sources. AAIPA may verify selected attributes but cannot promise that every item is complete, current or error-free. A person who identifies an error will use the correction channel in the Public Directory and Profile Publication Policy.

10. Links and external services

External websites, payment providers, maps, videos or social platforms operate under their own terms and notices. A link does not imply AAIPA endorsement or responsibility. Users will review the third party's conditions before providing information.

11. Availability and changes

AAIPA may maintain, change, suspend or withdraw website functionality. It may restrict access to protect security, users, clients or project information. AAIPA will give reasonable notice of material changes affecting registered services where practicable.

12. Enforcement

AAIPA may block traffic, restrict or terminate access, remove unlawful or unauthorised content, preserve relevant logs, investigate misuse and refer matters to affected parties or lawful authorities. Public disclosure of allegations is not an automatic remedy and will occur only where lawful, accurate, proportionate and procedurally fair.

13. Disclaimers

To the extent permitted by law, AAIPA provides the public website on an "as available" basis and does not guarantee uninterrupted operation, complete accuracy or suitability for a particular technical or commercial decision. Nothing in these Terms excludes a responsibility that cannot lawfully be excluded.

14. Liability

To the extent permitted by applicable law, AAIPA is not responsible for indirect or consequential loss arising solely from reliance on general public website information, unauthorised third-party conduct or events beyond reasonable control. This clause does not limit liability for fraud, wilful misconduct, personal injury caused by negligence, breach of non-excludable duties or obligations expressly accepted in a signed agreement.

15. Privacy and cookies

Personal information is handled under the AAIPA Privacy and Data-Use Notice. Browser technologies are described in the AAIPA Cookie Notice and Cookie Preferences. Public professional information is governed by the AAIPA Public Directory and Profile Publication Policy.

16. Governing law and disputes

These Terms are governed by the laws of Ghana, subject to mandatory consumer, privacy and other laws that apply to a user or location. A user will first send a written complaint to support@aaipaafrica.com so AAIPA can attempt good-faith resolution. An unresolved dispute may be brought before a court of competent jurisdiction in Ghana, without limiting a mandatory right or forum that cannot lawfully be excluded.

17. General provisions

If a provision is invalid or unenforceable, the remaining provisions continue. Failure to enforce immediately is not a waiver. Headings aid reading but do not limit meaning. The current published version applies from its effective date, subject to any signed agreement governing earlier conduct.
